Verification of the legality of an online store
Before making a purchase online, it is important to ensure that the store is legally registered in France and has the right to sell online.
You can verify this using the INSEE's national business and establishment directory (SIRENE) , via the Business Directory on data.gouv.fr:
A practical guide to checking a shop
- Take the SIRET number indicated in the legal notices of the shop.
- Go to the official directory and paste the SIRET number into the search bar.
- Check the information displayed:
- Company name *
- Address of the head office or establishment *
- SIREN/SIRET number
- APE/NAF code indicating the main activity.
* Their information can be hidden in the directory. Regarding Fourmitures, I chose to be hidden for fear of unsolicited calls or scam attempts; however, this information must be included in the legal notices.
Business activity codes (APE codes) authorizing distance selling / e-commerce in micro-enterprises (EI)
For an online store to be legally authorized to sell on the internet, its APE/NAF code must correspond to a distance selling activity. The most common codes are:
- 4791A – Distance selling via general catalog
- 4791B – Distance selling via specialized catalogue
⚠️ SCAM ALERT: Some shops are registered but do not have the correct APE code. They are therefore not authorized to sell online.
👉 What this means for the buyer:
- ❌ no obligation to provide customer service.
- ❌ No obligation to refund.
- ❌ No legal protection in case of dispute or non-delivery.
⚠️ Only companies with an APE code linked to distance selling offer a legal framework and real protection for buyers.
In summary
- A valid SIRET number alone is not enough to sell online.
- The company must have an APE code corresponding to distance selling / e-commerce in order to be in compliance.
- Checking this information helps ensure that your purchases are made from a registered, identifiable shop that complies with French regulations .
